Why the EPA Returned to J.H. Baxter

The U.S. Environmental Protection Agency has begun a second Time-Critical Removal Action at the J.H. Baxter Superfund site in West Eugene, Oregon. Work started September 14, 2026 and is expected to run into spring 2027.

This follows the agency's first emergency removal in summer 2024, which removed more than 750,000 gallons of hazardous waste and decontaminated or removed more than 65 tanks, vessels, sumps and related structures. While that work reduced immediate aboveground threats, sampling beneath the former tank farm, retort areas, wood-treating drip pads and drying shed revealed additional subsurface contamination.

The newly documented contaminants include pentachlorophenol, petroleum-based carrier oils, creosote-derived constituents and metals. EPA says the former drip pads themselves were also contaminated and must come out. February 2026 soil testing confirmed that contamination is still moving from soil into stormwater, which is why the agency is keeping the on-site stormwater treatment system running.

EPA has temporarily lined, backfilled and covered the known sources, and says there is no present threat to the community. But the new removal work is not the end of the story: it will not address all contamination, and longer-term remedial work will follow.

The first removal created physical access to areas that had been under tanks and buildings. That access allowed EPA to sample soil beneath infrastructure and confirm that contamination extends into shallow subsurface soils, not just the materials removed. The presence of pentachlorophenol and creosote-derived compounds is consistent with decades of wood preserving at the facility, but the key new fact is that the contamination remains mobile through stormwater.

Why Stormwater Is Driving the Second Action

February 2026 sampling confirmed a present, ongoing release from soil into stormwater. That changes the situation from a past site hazard to an active pathway that requires continued operation of the treatment system. EPA says it may use targeted removal, capping, or stormwater diversion so the site does not depend indefinitely on active mechanical treatment.

Removal Speed vs. Long-Term Remedy

This action belongs to EPA's Removal Program, which addresses known and accessible source material, near-term exposure and migration. The Remedial Program will separately evaluate broader groundwater, surface water, sediment, residential properties, and long-term cleanup alternatives. Because the site was listed on the National Priorities List in July 2025, the current work should be read as an early risk-reduction step inside a longer Superfund process, not a final cleanup.
